Terms of Service
These Terms of Service (Terms) govern your access to and use of Cluera, operated by AppHouse Pty Ltd ABN 28 694 651 011 (AppHouse, we, us, our), a company incorporated in Australia. By creating an account or using Cluera you agree to these Terms. If you do not agree, do not use the service.
1. Service Description
Cluera is a SaaS product that connects to your Etsy shop via the official Etsy API (read-only), analyses your customer reviews using AI, and delivers weekly insight reports by email. Cluera is designed for Etsy sellers who want to understand buyer feedback patterns and improve their listings.
The service includes a free tier and paid subscription plans (Pro and Growth). Features available under each plan are described on the pricing page at cluera.io/pricing and may be updated from time to time.
2. Eligibility and Account Responsibility
You must be at least 18 years old and have legal authority to enter into these Terms to use Cluera. By registering, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at yo@apphouse.com.au if you suspect any unauthorised access.
You may only register one account per Etsy shop. Creating multiple accounts to circumvent free-tier limits is prohibited.
3. Acceptable Use
You agree not to:
- Use Cluera for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorised access to our systems, other users' accounts, or any part of the service.
- Use automated tools to scrape, crawl, or extract data from Cluera beyond what the service expressly provides.
- Reverse engineer, decompile, or disassemble any part of the service.
- Transmit any material that is unlawful, harmful, defamatory, or infringes third-party rights.
- Interfere with or disrupt the integrity or performance of the service.
- Resell or sublicence access to Cluera without our written consent.
4. Etsy API Compliance
Cluera accesses your Etsy shop data through Etsy's official developer API under Etsy's API Terms of Use. As a user of Cluera, you acknowledge that:
- You must comply with Etsy's Seller Policy, Terms of Use, and all applicable Etsy policies at all times.
- Your use of Cluera does not grant you any rights in excess of those permitted by your Etsy seller agreement.
- We access only the data necessary to provide the service (read-only review data) and will not take any actions on your Etsy account.
- You can revoke our Etsy access at any time from your Etsy account settings.
The term “Etsy” is a trademark of Etsy, Inc. Cluera is not affiliated with, endorsed by, or certified by Etsy, Inc.
5. Subscriptions, Billing, and Cancellation
5.1 Plans
Cluera offers three plans: Free, Pro, and Growth. Paid plans are billed on a monthly or annual basis. Current pricing is published at cluera.io/pricing and may be updated with reasonable notice.
5.2 Billing
All fees are quoted and charged in Australian dollars (AUD) unless otherwise stated. Payment is processed by Stripe. By subscribing to a paid plan, you authorise AppHouse to charge your payment method on a recurring basis until you cancel.
Subscriptions renew automatically at the end of each billing period (monthly or annual). You will be notified in advance of any price changes.
5.3 Cancellation
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period; you will retain access to paid features until that date.
5.4 Refunds
Monthly plans: No refunds are provided for monthly subscriptions. You may cancel at any time and will not be charged for the following billing period.
Annual plans: If you cancel an annual plan within 14 days of initial purchase and have not generated more than 3 reports, we will provide a full refund. After that initial period, we will provide a pro-rata refund for the remaining full months of your annual subscription, less any processing fees. Refund requests must be submitted to yo@apphouse.com.au.
Nothing in these Terms limits rights you may have under the Australian Consumer Law.
5.5 Plan Changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with a prorated charge. Downgrades take effect at the start of the next billing period.
6. AI-Generated Content Disclaimer
Cluera uses Anthropic's Claude AI to analyse your review data and generate insight reports. These reports are informational tools only and do not constitute professional business, legal, financial, or marketing advice.
AI-generated content may contain errors, omissions, or misinterpretations. You are solely responsible for evaluating the reports and for any business decisions you make based on them. AppHouse makes no warranty as to the accuracy, completeness, or fitness for any particular purpose of AI-generated reports.
7. Intellectual Property
All software, design, trademarks, and content comprising the Cluera platform are owned by or licensed to AppHouse and are protected by Australian and international intellectual property laws.
You retain all rights to your own data (reviews, shop information). By using Cluera, you grant us a limited, non-exclusive, royalty-free licence to process your data solely to provide the service to you.
You may not copy, reproduce, distribute, or create derivative works from any part of the Cluera platform without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, AppHouse and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities.
- Business decisions made in reliance on AI-generated reports.
- Loss or corruption of data.
- Interruption of service or downtime.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of Cluera will not exceed the total fees you paid to us in the 12 months immediately preceding the event giving rise to the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law, including for significant personal injury or death caused by negligence.
9. Warranties and Service Availability
Cluera is provided “as is” and “as available” without warranties of any kind, express or implied, except as required by the Australian Consumer Law. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.
We reserve the right to perform maintenance, updates, or modifications to the service, which may result in temporary unavailability.
10. Termination
You may close your account at any time by contacting us at yo@apphouse.com.au or through your account settings.
We may suspend or terminate your account immediately if: (a) you materially breach these Terms; (b) we are required to do so by law; (c) your use creates a security risk or causes harm to other users or the service. We will give you reasonable notice where practicable.
On termination, your right to use the service ceases immediately. Sections 6, 7, 8, and 11 survive termination.
11. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of Cluera will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
Before commencing formal proceedings, we encourage you to contact us at legal@apphouse.com.au to resolve disputes informally.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and by posting the revised Terms on this page with an updated date. If you continue to use Cluera after the effective date of a change, you accept the revised Terms.
If you object to any changes, your sole remedy is to stop using the service and cancel your subscription.
